The DUI/DUAC charge is a criminal charge and will follow a path through the county criminal court system. If you blew a .15 or more on the breathalyzer test or refused the test, your license may be suspended, triggering a second case in the administrative system. You may qualify for a provisional, route restricted, or temporary alcohol license that will get you back on the road.

In your criminal case, you must remember that you are innocent until proven guilty. Your recent experience with an officer probably made you feel differently, but this is why the charge is only an allegation. The officer, or the State, must prove the elements of DUI/DUAC. Our job is to focus on the evidence and the procedures. The officer may not have the evidence required to pursue the case. The video of the arrest could have insufficient evidence or flaws. You must remain hopeful while your case works its way through the system. Before your first court appearance or at the first appearance, we will request a jury trial. Then you wait.
